Terms of Service

These Terms of Service ("Terms") govern your use of software published by Cinderpoint Systems LLC ("Cinderpoint", "we", "us") under its Cinderpoint (apps) and Rusthorn (games) imprints. They are deliberately short: our software runs on your own device, needs no account, and collects no personal data. How you obtained it decides some of the details. If you got it from a platform store (Steam, Apple App Store, Google Play, Itch, and the like), that store provides its own end-user license and governs purchases, refunds, and account matters. If you got it directly from us (a free download or an in-browser product on cinderpoint.com), these Terms are your license and there is nothing to purchase.

Who We Are

Our software is published by Cinderpoint Systems LLC, operating under the Cinderpoint (apps) and Rusthorn (games) imprints. For any question about these Terms, contact us by email (see Contact below); a mailing address is not published here per our minimum-exposure policy. (The company's state of formation is named in the governing-law section below.)

Your License

You receive a personal, non-exclusive, non-transferable license to install and use our software for your own use. Where that license grant comes from depends on how you obtained the product. If you got it through a platform store, that store's end-user license agreement governs the grant, and we do not add a separate acceptance gate. If you got it directly from us, whether a free download or an in-browser product hosted on cinderpoint.com, these Terms are that license, granted to you free of charge for as long as you comply with them. Either way, you may not resell, redistribute, rent, or sublicense the software, or remove its copyright and trademark notices.

Intellectual Property

The software, its source code, artwork, audio, text, characters, and the Cinderpoint and Rusthorn names and marks are owned by Cinderpoint Systems LLC or its licensors, and are protected by copyright and trademark law. Nothing in these Terms transfers that ownership to you. Fictional brands, organizations, and characters within our games are inventions used for storytelling and are not affiliated with any real entity.

Provided "As Is", No Warranty

Our software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error-free, or compatible with every device or configuration. Some places do not allow the exclusion of implied warranties, so part of this exclusion may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Cinderpoint Systems LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of or inability to use the software. Our total liability for any claim relating to the software will not exceed the amount you paid for it. Some places do not allow these limitations, so part of this section may not apply to you. Nothing here limits any liability that cannot be limited under applicable law, or any rights you have under mandatory consumer-protection law.

Purchases, Refunds, and Disputes

Any paid product is purchased through the platform store you bought it from, not from us directly. Refunds, billing, chargebacks, account suspension, and related disputes are governed by that platform's policies (Steam, GOG, Apple App Store, Google Play, Microsoft Store, Epic Games Store, Itch, or your console store); please direct those requests to the platform. Products offered directly from cinderpoint.com are provided free of charge, so there is no purchase, payment, or refund to process.

Acceptable Use

Please do not reverse-engineer, decompile, or disassemble the software except where applicable law expressly permits it; do not circumvent technical protections; and do not use the software to infringe others' rights or to break the law. These are ordinary limits; where you obtained the product through a store, they mirror the platform license you already agreed to.

Changes to These Terms

We may update these Terms from time to time. When we do, the effective date above changes and the current version published at cinderpoint.com/terms.html governs. Continued use of the software after an update means the updated Terms apply to that use.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law where you live provides otherwise. This does not deprive you of the protection of the mandatory provisions of your local law.
